1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and JAALLE (“JaallePay,” “we,” “us,” or “our”) governing your access to and use of the JaallePay mobile applications, website (jaallepay.com), desktop application, and all related services (collectively, the “Services”).
By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
2. Eligibility
- You must be at least 18 years of age to use JaallePay.
- You must have a valid mobile phone number from a supported country (Somalia, Somaliland, Puntland, Djibouti, Kenya, Ethiopia, or diaspora regions).
- You must not have been previously suspended or removed from the platform.
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account credentials, PIN, and biometric access.
3. Account Registration & Security
3.1 Registration
You register using your mobile phone number and verify ownership via OTP (One-Time Password). Your account is linked to your phone number and device. You may only maintain one active JaallePay account.
3.2 Identity Verification (KYC)
Your transaction limits are determined by your JaalleID verification level. You may be required to complete additional verification to access certain features:

3.3 Account Security
- You must set a 5-digit PIN and are encouraged to enable biometric authentication.
- You are responsible for all activity under your account.
- Notify us immediately if you suspect unauthorized access.
- We may freeze your account if suspicious activity is detected.
- A duress PIN is available — entering it silently alerts our security team.
4. Services Description
JaallePay provides the following financial services:
- Peer-to-Peer Transfers: Send and receive money across 11 payment networks including EVC+, ZAAD, eDahab, Golis, Premier Wallet, Waafi, M-Pesa, Telebirr, and bank cards.
- Cross-Network Transfers: Send money between different mobile money networks (e.g., EVC+ to eDahab).
- Merchant Payments: Pay merchants via QR code (SomQR standard), payment links, or direct transfer.
- Airtime Top-Up: Purchase mobile airtime for any Somali network.
- Bill Payments: Pay utility bills, insurance, and other recurring obligations.
- Remittance: Send money from diaspora countries to any Somali mobile wallet.
- Ayuuto: Participate in rotating savings circles (ROSCA) with automated collection and distribution.
- Deeq: Access microloans with transparent fee structures (not interest-based).
- Xisaab: Personal and business accounting and invoicing tools.
- Bulk Payments: Send payments to multiple recipients simultaneously.
- Currency Exchange: Convert between supported currencies (USD, SOS, KES, ETB, DJF, EUR, GBP, SAR, AED).
- SIPS Bank Transfers: Transfer money to and from Somali bank accounts via the national payment switch.
- Escrow: Secure marketplace transactions with buyer protection (Xafiid).

Fees are displayed before you confirm any transaction. We reserve the right to modify fees with 30 days' notice.
6. Prohibited Activities
You agree not to use JaallePay for:
- Money laundering or terrorist financing
- Fraud, scams, or deceptive practices
- Transactions involving illegal goods or services
- Circumventing transaction limits or KYC requirements
- Creating multiple accounts or using false identity information
- Attempting to reverse-engineer, hack, or compromise our systems
- Using automated systems (bots) to make transactions without authorization
- Facilitating payments for sanctioned individuals or entities
- Any activity that violates Somali law or the laws of the jurisdictions in which you operate
Violation of these prohibitions may result in immediate account suspension, fund seizure, and reporting to law enforcement and the Financial Reporting Centre (FRC).
7. Disputes & Refunds
- Transaction Disputes: You may file a dispute within 30 days of a transaction through the app or by contacting support.
- Investigation: We will investigate disputes and aim to resolve them within 15 business days.
- Escrow Disputes: Escrow transactions have built-in dispute resolution with dual-confirmation release.
- Refunds: Approved refunds are processed within 5 business days to your JaallePay wallet.
- Chargebacks: Bank card chargebacks are handled through Stripe's dispute process.
- Scam Reporting: Report suspected scams through our Community Protection feature. Confirmed scam numbers are added to our blacklist.
8. Limitation of Liability
To the maximum extent permitted by law, JaallePay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including but not limited to loss of profits, data, or business opportunities.
Our total liability for any claim arising from these Terms or the Services shall not exceed the total fees you paid to JaallePay in the 12 months preceding the claim.
We are not liable for delays, failures, or losses caused by: (a) mobile money network downtime, (b) telecommunications outages, (c) force majeure events, (d) actions of third-party payment providers, or (e) your failure to maintain account security.
9. Indemnification
You agree to indemnify and hold harmless JaallePay, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any applicable law, or (d) your infringement of any third-party rights.
10. Intellectual Property
The JaallePay name, logo, app design, and all related trademarks, service marks, and trade dress are the property of JAALLE. The Services, including all software, content, and documentation, are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Services without our prior written consent.
11. Termination
- By You: You may close your account at any time through the app settings. Outstanding transactions will be completed or refunded before closure.
- By Us: We may suspend or terminate your account immediately if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or pose a risk to our platform or other users.
- Effect: Upon termination, your right to use the Services ceases. We will retain your data as required by law (see Privacy Policy).
- Remaining Funds: Any remaining balance in your wallet will be returned to you via your preferred withdrawal method, minus any outstanding fees or disputed amounts.
12. AML/CFT Compliance
JaallePay is committed to preventing money laundering and terrorist financing in accordance with the Central Bank of Somalia's Mobile Money Regulation 2020 (amended 2021) and the Financing of Terrorism Law. We implement:
- Risk-based KYC verification (JaalleID L0–L4)
- Transaction monitoring with 27 fraud detection rules
- Suspicious Activity Reporting (SAR) to the Financial Reporting Centre
- Sanctions screening against UN, OFAC, and regional lists
- PEP (Politically Exposed Persons) screening
- Immutable audit trails for all financial operations
- Velocity limits and anomaly detection
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Somalia. Any disputes arising from these Terms shall be resolved through negotiation, mediation, or, if necessary, the competent courts of Somalia. For cross-border disputes involving diaspora users, the laws of the user's jurisdiction may also apply to the extent required by local consumer protection regulations.
15. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated via in-app notification at least 30 days before taking effect. Your continued use of the Services after the effective date constitutes acceptance of the modified Terms. If you disagree with any changes, you must stop using the Services and close your account.
